Terms of Ordering and Disclaimer
Thank you for your interest in purchasing original artwork by Kyoko Bartley. Please read the following terms carefully to ensure you fully understand and agree to them before placing an order.
Order and Payment Process
Initial Inquiry: Prospective customers must first contact Kyoko via email with a detailed description of the desired artwork, including any reference materials, special requests, deadline, and shipping preferences.
Response and Pricing Confirmation: Kyoko will review the request, ask any necessary questions, and provide a final price quote, along with shipping options and an estimated delivery timeline.
Customer Agreement: The customer confirms their intent to proceed or cancels the order at this stage. Any changes to the request must be communicated and confirmed at this point.
Payment Requirement: Kyoko will issue a payment request via email. Payment methods include PayPal, Venmo, or Zelle.
Work Commencement: Upon receipt of payment, Kyoko will begin work. No changes can be made to the order once work has started.
Completion and Shipment: Once completed, Kyoko will send the artwork along with the tracking information and other shipping details.
Final Sale and Refund Policy
No Returns or Refunds: All sales are final. By placing an order, you agree to these terms and acknowledge that no returns or refunds will be offered once the order is completed.
Full Customer Consent Required: By placing an order, you are agreeing that the work produced is based on the description and requirements you provided. Changes to the artwork request cannot be made after payment is received, as work begins immediately upon confirmation.
Order Requirements and Additional Information
Personal Information: When placing an order, please provide your full name, email address, phone number, and postal address, as well as any specific instructions for delivery. Shipping insurance is recommended and available upon request. Kyoko usually uses USPS Priority Mail which includes insurance and tracking.
Details of Artwork: Include a clear description of what you want (e.g., “portrait of my pet” or “a cartoon character for publication”), with reference images and desired artistic style (e.g., “soft and joyful,” “high contrast”, “make look like smiling”). Be sure to state your budget and desired completion date, taking into account the time required for shipping.
Privacy and Information Handling: All reference images and personal information provided will be handled with strict confidentiality and deleted or returned upon completion of the project.
Ownership and Usage Rights
Artwork Ownership: Upon receipt, the artwork is yours to use as you choose, including for publication or merchandise. However, the customer accepts all legal responsibility for how the artwork is used.
Right of Refusal
Discretionary Refusal: Kyoko reserves the right to decline any commission request without the obligation to provide an explanation. In such cases, you will be informed promptly, and no payment will be required or retained.
